Delivery and Return Terms

1. Scope

These Terms govern delivery and returns of the products sold by ELEGANCE GRUP TURİZM VE OTOMOTİV TİCARET LİMİTED ŞİRKETİ. Contact: info@elggassprings.com, +90 212 671 52 97.

2. Delivery period and conditions

The delivery date or period applicable to the product and order is shown in the order summary before payment details are entered and repeated in the order confirmation.

Unless otherwise stated in the order confirmation, the period for a prepaid order begins after full receipt of the price; where technical information is requested from the Buyer, it begins after all required information is received. Delivery is made to the address and authorised recipient stated by the Buyer in the order. Additional costs caused by incorrect or incomplete information or failure to take delivery are borne by the Buyer.

3. Carriage charges and risk

Unless otherwise stated in the order confirmation, the place of performance is the Seller's address at İkitelli OSB Mah. Demirciler C5 Blok Sk., Demirciler Sanayi Sitesi C5 Blok No: 241/B, Başakşehir / İstanbul / Türkiye. If the Buyer requests shipment to another address, carriage and any insurance charges are borne by the Buyer and shown before the order.

For shipment to another place at the Buyer's request, benefit and risk pass to the Buyer when the product is handed to the carrier. The Seller remains liable for its fault, any pre-delivery defect and inadequate packaging.

4. Inspection on delivery and carriage damage

The Buyer inspects the product and packaging on delivery. Visible loss or damage is notified to the carrier no later than delivery; concealed carriage damage within seven days after delivery; and delay within twenty-one days. The Buyer sends the carrier's report and other records to the Seller without delay. These carriage notices are separate from any defect notice to the Seller.

5. Notice of defects

The Buyer inspects, or has inspected, the product on delivery and notifies the Seller of any defect without delay. A latent defect appearing later is notified as soon as it is discovered. The notice periods laid down by law remain applicable.

Where the Buyer is a consumer, the rights arising from consumer legislation remain applicable.

6. Return procedure and costs

There is no unilateral return or cancellation for non-defective products. A discretionary return is possible only with the Seller's prior written approval; outward and return carriage charges and any loss in value attributable to the Buyer are borne by the Buyer.

Where a defect is claimed the Buyer preserves the product and stops using it, and requests a dispatch instruction by sending the order/product code, quantity, description and any photographs or reports to info@elggassprings.com. The return carrier and address are notified in the Seller's written dispatch instruction. The product must not be sent without that written instruction.

If the product was defective at delivery, the Buyer may, subject to the statutory conditions, choose rescission, a price reduction, repair free of charge or, where possible, replacement with a non-defective equivalent. Subject to the statutory conditions, the Seller may prevent the chosen remedy by immediately supplying a non-defective equivalent and compensating all loss.

Where the defect is attributable to the Seller, necessary and reasonable return/repair carriage charges are borne by the Seller. If there is no defect, or the issue results from the Buyer's selection, technical information, installation, use, storage or unauthorised alteration, those charges are borne by the Buyer.

When a repayment obligation arises following valid rescission, the price is returned without delay, as a rule to the payment instrument used. Claims arising from defects are subject to a two-year limitation period from transfer; the Seller's gross fault remains reserved.

7. Notices and effective date

Operational notices may be sent to info@elggassprings.com. Formal notices are given in accordance with the methods prescribed by law. This English text is a faithful translation; the Turkish text prevails in the event of any difference.
